EASTHAM BOARD OF HEALTH MEETING
THURSDAY, JULY 26, 2007 AT 3:P.M.
PRESENT: Paul Lothrop, Chairman, Pat Lariviere, Dr. Stan Holt,

The Chairman opened the meeting at 3: p.m.
OPENING STATEMENTS:
Jane Crowley informed the Board that the Household Hazardous Products Collection for Eastham and Orleans which was held July 21, 2007 in Eastham was a success. The next Hazardous Waste day will be held in Orleans September 15th
9 am to noon at Orleans Highway Garage- Bay Ridge Ln.
The Health Agent also stated that a resident may have had contact with a bat. A specimen sent to be tested did not determine that the bat had rabies. In order to be safe it was recommended that the person receive treatment.
VARIANCES:
1. Benson 230 Corliss Way Map-18 Parcel-4
Stephanie Sequin requested a well variance due to high iron level not suitable for water supply (well already installed per emergency conditions)
Due to water quality issues the well driller was not able to place the well in the proposed location approved 8/31/2006. The well has been located 66 ft. from the cesspool.
Due to water quality limitations Ryder and Wilcox and the licensed well driller relocated the well to the best possible option for this lot. The water quality results show results within recommended approval.
The Board approved the relocation with these conditions:
1. Well to be tested 2 times the first year for voc and routine parameters and annually in the future
2. Well variance form to be signed by the owner
3. Board of Health to reaccess septic system at the time of transfer or when additional habitable space is added
4. Septic system required to be upgraded at the time of transfer with approved engineered septic plan.
Stan made the motion to approve the relocation of the well with the 4 conditions.
Beverly Knox seconded the motion.

Jason Ellis presented the revised plans dated 7/3/2007 to upgrade the septic system. The variances requested are as follows:

1. 5' from proposed sas to lot line (plc.47)
2. 5' from proposed s.a.s. to lot line (road)
3. 25'from proposed s.a.s. to top of coastal bank

4. No reserve area provided

8. Waive requirement for nitrogen reducing septic system
A neighbor Larry Jasper spoke in favor for this project. His property is at 10 Bens Way.
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. Routine water quality test results be provided of existing well location to assure potability
2. No increase in design flow be allowed
3. Deed restriction for 3 bedroom use to be recorded on deed
4. Require recording on deed that when property is tranferred that secondary treatment to be added to the existing septic system

The new owner will be required to have the secondary treatment and monitoring of property under general use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS, Nitrate (or 2 times per year for seasonal use), after this time reduction of testing could be requested to BOH by owner. Effluent nitrate-nitrogen limit not to exceed 19mg/1.
Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.
Designer to verify proper operation of the system prior to issuance of Certificate of Compliance.

Laura Scholfield presented the revised plan dated July 19, 2007 to upgrade the septic system including secondary treatment using Waterloo Biofilter UG-550N. The variances requested are as follows

Both lots A and B are designed with Septitech technology under provisional approval which will limit nitrate-nitrogen to 19 mg/1. New wells will be required to be tested for VOC and routine parameters as private wells. If occupancy exceeds 25 people per day for more than 60 days per year the wells would be classified as public supply wells.
Finding that the plan achieves maximum feasible compliance, the aforementioned plans were approved with the following conditions:

If property is developed as condominiums an agreement should be provided that will detail ownership responsibilities related to operation and management of the septic system and shared facilities. The Health Agent recommends the Board of Health require escrow funds to cover operational costs and possible repairs that might become necessary. Town council should review and approve any such agreement prior to approval.
Any change in use or addition of habitable space in any part of buildings on Lot A or
Lot B is subject to Board of Health approval .

Bamford 17 Beach Plum Road Map-13 Parcel-185
Chris Thompson submitted a request for a building permit to add additional square footage to an existing dwelling. The Board of Health reviewed this project, because this is an environmentally sensitive lot. The Board granted their approval with the following conditions:
1. Alternative treatment septic design to be submitted within 60 days
2. Installation of system within one year
Secondary treatment and monitoring of system conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS,Nitrate (or 2 times per year for seasonal use) After this time reduction of testing could be requested to the Board of Health by the owner. Effluent nitrate-nitrogen not to exceed 19 mg/1.
Operation and maintenance agreement to be submitted to Eastham Board of Health. Operation and maintenance agreement to be required for life of the system. Operator to report results via Carmody Data base provided through Barnstable County Health or directly to the Eastham Health Department if not available.

Charles Miller requested a building permit to demolish and rebuild a 4 bedroom dwelling. This property has a Title 5 system that was installed in 2005 with a mounded pressure dosed leach area with (1 )sideline set back variance. The Board of Health reviewed this project, because this is an environmentally sensitive lot and found the existing septic system will provide adequate protection to the environment for the proposed dwelling.
Stan Holt made the motion to approve the request.
Pat Lariviere seconded the motion.

George Reilly upgrade the septic system with Orenco Avantex technology as listed per plan dated 5/31/2007 - (revised July 17, 2007). The plan submitted requests provisional use for nitrogen credit for a 3 bedroom dwelling on a 20,000 sq ft lot. No variances are requested.
Approval was granted with the following conditions:
Voc and Routine water quality test results be provided of existing well location to assure potability.
No increase in design flow be allowed
3. Secondary treatment and monitoring with Orenco Advantex technology under provisional use approval conditions per DEP regulations including testing quarterly for total nitrogen, BOD, TSS,Nitrate (or 2 times per year for seasonal use) Effluent nitrate-nitrogen not to exceed 19 mg/1.
